LEGAL TERMS AND CONDITIONS OF THE RAFFLE

 
1. Organizer

 
GRUPO PADEL XXI, S.L. (hereinafter, Padel Nuestro), with CIF B73767261, located at Polígono Industrial Oeste, calle Venezuela 17, Alcantarilla (Murcia), and contact email contacto@360padelgroup.com, is the organizer of this Raffle (hereinafter, the Raffle), which will be governed in accordance with these terms and conditions (hereinafter, the Terms).
Participation in the Raffle implies acceptance of these Terms, therefore any declaration of non-acceptance of all or part of these Terms will result in the participant's exclusion from the Raffle, and Padel Nuestro will be released from fulfilling the obligation towards such participant.

2. Scope 

The geographical scope will be worldwide and through the Padel Nuestro website.

3. Duration of the Raffle 

The Raffle will run from May 14th at 10:00 AM until May 21st, 2025, at 11:59 PM (Spanish time).

4. Participation Requirements 

To participate in the Raffle, the following requirements must be met:

• Be over 18 years old
• Make a purchase of Adidas products (paddles or padel bags by All4Padel) that will be identified on the website.
• Comply with any other obligation set forth in these Terms 

5. Prize 

The Raffle will have six (6) winners and the Prize consists of:

• 3 Adidas paddles signed by the player Martita Ortega
• 3 Adidas paddles signed by the player Ale Galán

Padel Nuestro reserves the right to modify the Prize mentioned above if justified objective causes arise, with another of similar or higher value and characteristics.

6. Selection of the Winner 

The Raffle will be held on May 22nd, 2025.

The Raffle will have six (6) winners (Winners) and six (6) substitutes (Substitutes), the latter being designated in case any Winner renounces and/or does not meet the requirements established in these Terms.

The Raffle will be carried out through the Easypromos platform, which is a tool that facilitates the efficient and automatic management of random raffles, ensuring a transparent and reliable process. Padel Nuestro is committed to conducting the Raffle with criteria of transparency, security, and non-discrimination.

After the Raffle is held, Easypromos will issue a Validity Certificate, which will include the total number of finalists, the internal reference of the raffle in Easypromos, the date and time of the raffle, and the list of winners and substitutes obtained. The Certificate has a unique internet address and is publicly accessible.

The Prizes will be awarded to participants who meet the requirements set out in these Terms and are selected as winners of the Raffle. The winners will be selected from all participants who have validly registered for the Raffle in accordance with the Terms. In any case, failure to comply, in whole or in part, with any of the requirements established in these Terms will result in the automatic disqualification of the participant, and Padel Nuestro will have the right to revoke the assignment of the Prize to the Winner(s), without generating any right to claim.

Under no circumstances will the winners of the Raffle be able to request a change, alteration, or compensation of the Prize. The commercialization, sale, resale, or any other similar form of the Prize is prohibited.

7. Notification of the Winner and Prize Delivery 

The Winners will be informed via their personal email, which will serve as the means of communication between the parties. The notification of the winner will be made on May 22nd, 2025.

If any winner renounces the Prize or does not respond to Padel Nuestro’s request for information within seven (7) days of the winner notification email, Padel Nuestro will assign the prize to the next Substitute, until all prizes are distributed. If this is still not possible, Padel Nuestro reserves the right to declare the Raffle void.

Participants wishing to submit any claim or complaint regarding the development of the Raffle may do so within a maximum period of seven (7) days from the end of the Raffle by sending an email to the address provided in point 1.

The Winners will be solely responsible for any tax or other obligations related to receiving the Prizes.

The Prizes will not be sent to the Winners until June 13th, 2025, respecting the 30-day product return period.

Padel Nuestro will be responsible for the shipping of the Prizes, but not for customs fees, taxes, or any other necessary procedures to receive the prizes; the Winners will have to cover this cost.

8. Reservation of Rights 

Furthermore, Padel Nuestro reserves the right to modify or expand these Terms, as long as it does not harm or undermine the rights of the participants.

Padel Nuestro reserves the right to exclude participants who violate the rules established in these Terms or who engage in behavior that harms the image of Padel Nuestro or causes damage to the company.

9. Limitation of Liability 

By way of example and not limitation, Padel Nuestro is not responsible for any event or behavior attributable to third parties that may cause delays, loss, or any other circumstance that may affect the proper development of the Raffle, such as, but not limited to, issues arising from the COVID-19 pandemic, force majeure, states of emergency, sit-ins, exceptions, attacks, or computer errors or similar situations.

Specifically, Padel Nuestro is not responsible for the management or mismanagement that may occur by the providers of the Prize to the winner.

Padel Nuestro will not assume any obligations or liabilities regarding the Winner’s obligations related to the Prizes. The tax, administrative, or other obligations will be the exclusive responsibility of the Winner, leaving Padel Nuestro harmless from any liability.

10. Protection of Personal Data 

Registration and participation in the Raffle entails authorization for Padel Nuestro to process their personal data. Therefore, in accordance with Regulation (EU) 2016/679 of the European Parliament and the Council, of April 27, 2016, (GDPR) and Organic Law 3/2018 of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), we inform you as follows:

Legal Basis and Purpose: The legal basis will depend on the specific purpose of processing personal data:

• 1. To facilitate the proper management, development, and control of the Raffle, including sending confirmation communications to participants and winners to proceed with the delivery of the Prizes.
• 2. Subscription to the Padel Nuestro mailing list, which will involve sending commercial communications, with the legal basis being the consent expressed through participation in the Raffle.

Data Transfer: The personal data of participants will not be transferred, except to the providers necessary for the development of the Raffle (Easypromos) and the service provider for transportation and/or when required to comply with our legal obligations.

Exercise of Rights: Any participant will have the right to (i) withdraw consent at any time; (ii) Right of access, rectification, portability, and deletion of their data, and to limit or object to their processing; (iii) the right to file a complaint with the supervisory authority (www.aepd.es) if they believe the processing does not comply with applicable law.

11. Applicable Law and Courts 

The applicable law for this Raffle will be Spanish law. Any disputes regarding the validity, effectiveness, interpretation, and execution of this Raffle, the participants, waiving their own jurisdiction, expressly agree to submit to the jurisdiction and competence of the Courts of Murcia.
